Legal Issue on Contract Law in Malaysia - Good for us to know

Do you notice that most of the time, the receipt / invoice you received from the merchant carries this exclusion clause or similarly worded statement: "Goods sold are not returnable" or "No refund once sold".

Please remember that : "As long as your goods is purchased for home use and not for business ( i.e. to be resold), the above exclusion clause is VOID".

That means, as long as the good is defective, regardless of what is worded, you CAN get back all your money spent . You do not have to accept a repair on the good or an exchange. You CAN ask for a refund. AND you are LEGALLY right and entitled to!

And most of the time the merchant will refuse to return you your money.

You can threaten the merchant with four words: "SEE YOU IN COURT!"

The court here refers to the Small Claims Tribunal Court . Any goods which is worth RM25,000 and below can apply to this Court.

However, you don't have to tell them what court! All you have to pay is RM10 admin fee and the loser (the merchant) will have to refund you the money PLUS the admin fee!

I have seen that most educated people are cowed by such unfair wordings (which includes a few of my friends). Pls try not to let the merchant fleece you the next time you have defective goods. You can file this On the 16th floor of Putra Place (The Mall opposite Putra World Trade Centre) . The form cost RM5.00. The Tribunal will settle within 2 months period.

Europe for beginner - Dare or Not

For many malaysian i know, travelling alone & backpacking is not the choice. They would rather go by groups, or visiting family or friends or on business trips. As my trip already concluded, now it is the time for me to remember everthing back ( with the help of my pics and my bills **i kept all my bill, tickets, and anything useful) and put in this blog.

My initial plan was to visit Western Europe and cover some part of the east europe (Czech & Slovakia) as you can scroll at the bottom of this blog of my itinerary. But my savings was for 2 years, and itinerary for 6 months ahead ( as most the place i visit are my friends place).

So, what you need before you travel?

  1. Your budget! - this is the most important. Like mine, i put roughly around RM20K to RM25K, but turn out, I only spent RM15 . Only?? hahaha... banyak jugak oiii..
  2. Itinerary - I will summarize later.
  3. Accomodation - Friends or Hotel/Hostels
  4. Will writing.. haha ..no lah, actually all documents required for travel. But, I did update all my insurances, bank account and give to my sister in case of anything happen.

So, my budget is like this:-

1) Preparation - Backpack/Camera/Extra cloth /Ration

The first thing i buy for my trip is Lonely Planet - Europe on a shoestring. A very fat book that cause my body weight to loss 4 kilos (maybe my fat camera as well). it cost RM100. Then, i buy my backpack, deuter 65Liter which i weighted 21Kilos when i arrived in KL. 16Kilos when I depart from Kuala Lumpur (KL). You need this kind of good back as you dont want the bag to koyak in the middle of travel. Mahal oo nak beli kat sana.

Of course! you need to buy EURO money! i bought Euro early year as the price is the lowest. You should check on the Yahoo Currency Converter and you can find the patern of the exchange rate. http://finance.yahoo.com/currency/convert?amt=1&from=EUR&to=MYR&submit=Convert. I changed for 4.65 Ringgit for EUR1.00. That is the cheapest i got. And dont change your money at the airport lah...

Finally, 1 months prior to departure, you must have everthing complete. Not including all the maggie mee, biscuits etc. You only buy this this a week before, nanti jadik bubur pulak.

Meanwhile, you must have:-

  • Passport : RM300
  • Camera : I bought Panasonice FZ50 (10Megapixel, 12X optical Zoom) + Flash = RM2500
  • Insurance: RM150
  • Air ticket : RM3300, Qantas Airways transit in Singapore. MAS mahal kalau nak beli , dlm RM4500 kot. Kat MATA fair pun susah nak carik. Last2 beli dgn Agent ( kawan recommend).
  • EURO money! = I bring EUR1000 cash and split into 3 wallets. :-)
  • Eurailpass : you must have this, and buy 1st class if you are single traveller. You will enjoy the nice seat and scenery. I bought Eurailpass Select (5 countries: German, BENELUX(Holland+Belgium+Luxembourg), Swiss, France, Austria) for RM2500.

From my experience, you better prepare everthing 1 month prior to departure. In case of anything happened. Except the money, but i managed to hide under my pillow ( you think i want to tell the exact place ka?).

And dont forget to settle your credit card! it is easier to use credit card rather than you have to withdraw your money overseas. Pay your bills before you depart! Ask your neighbour to take care of your house or you ask your friend to stay at your place.

Ah, i almost forgot about my itinerary and my budget to go to each place. But, i will write later!

At last, i did it!

it takes more than a week to get out from this jet lag. and now i should write my nearly-month journey in mostly western europe: Germany, Holland, Swiss, Austria, France and Belgium. Above all, i already visited more than 14 different towns/city.


So, which town is the best? how much you spent? do you meet your special friends? all such questions come from people not just malaysia, also while i travel. I have never imagined before that i can to to Berlin, i can touch snow, met my old friend after 10 years apart. What a mix feeling. au revoir france. c'etait tres belle cite avec le lumier dans tour eiffel. je peux parle un peu francais maintenant parce qui je dois parler francais a mulhouse beaucoup. il n y a beaucoup le gens qui peux parler bien anglais la. merci bien kamel pour votre introduction le francais morocoque wedding. c'est magnifique.

first time naik TGV! dan tren lambat bertolak. sampai paris pukul 11:30PM. lambat 1 jam. TGV kalau lambat 30 minit akan bayar balik duit 1/2 payment. kalau lambat 1 jam, dia bayar full payment.

sampai je paris, terus naik metro ke rumah member , Imran, diplomat UNESCO. rumah dia cantik betul, dapat tengok La tour Eiffel dari tingkap rumah.

satu hari jalan kat paris start dari tour eiffel hingga ke notre dame.

besok nak pergi ke mulhouse pulak, tengok member perancis kawen.

selepas satu hari suntuk berjalan2 di geneve semalam dan hari ni naik cable car dekat salave. yang lagi tinggi(agaknya) dari langkawi cable car, akhirnya , malam ni aku bertolak ke interlaken untuk menuju ke puncak tertinggi gunung di western europe, jungfrauroch.

geneve banyak bangunan lama dan semua brand jam yang mahal2 boleh jumpa kat sini, patek philips, maurice le'croiq, tissot, omega.

selepas interlaken, maybe menuju ke munich.

aku sampai geneve pakai tren dari berlin pukul 11pm. tren kat sini memang tepat sampai. cuaca kat sini agak panas, tapi still sejuk...sebab tengok dah ramai yg seksi2..hehe. soonja yg penah duduk malaysia setahun datang ambil kat stesen keretapi. masih fasih berbahasa melayu.

pagi ni agak letih nak keluar awal. check email dulu dan rancang nak pegi mana pagi ni... maybe nak pergi UN dulu..lepas tu jet d,eau.

salam goodbze dari berlin. kejap lagi nak naik keretapi lajujerman ICE dari Berlin ke Geneve, ambil masa dlm 6 jam. boleh tidor atas tren. cuaca pagi ni agak cerah dari hari2 biasa zg agak mendung. ingatkan summer panas, tapi sejuk. cuaca dlm 12-19 celcius...

bze bze
tren dari amsterdam ke berlin sunggung memenatkan. ingatkan dapat tren laju, tapi, dpt tren cikai yg mcm kat malazsia. tapi tren ke geneve dari berlin jumaat ni nanti, aku naik tren laju , ICE. cuaca kat sini agak sejuk berbanding amsterdam dan tak menentu. akibat global warming. sebab tu EU ambil berat pasal global warming. kejap hujan, kejap terang, kejap gelap..

semuanza terbalik. makanan kat sini utk muslim, susah carik berbanding amsterdam yg ramai orang turki. tapi nasib baik aku tinggal ngan member aku nie yg duduk kat kawasan islam. bismillah je ler.

hari pertama kat berlin, berjalan kaki dari rumah member, konstantin ke pusat bandar, berjalan di tepi sungai menyusuri tembok berlin. tapi bila sampai ke memorial tembok berlin, dah tutup. sayup. besoknya , aku terus pergi ke berlin tower, tengok satu berlin dari tower... tower dia mcm telkom tower KL, tapi pendek jer.. 200M kot. lepas tu, duduk kat luar, makan pis dlm tin dengan burung2 jinak kat luar... teringat cerita beauty and the beast tu.. burung2 merpati ngan burung kecik yg ada kat malazsia tu pun ada kat sini.. rupanza burung satu dunia...

malam nya pulak, konstant bawak ke majlis hari jadik kawan housemate dia.. makanlah kek yang diorang masak. memang sedap.. termasuk vegeterian pizza...

hari ni, nak habiskan ronda bandar berlin yang dah total destroy akibat perang.. memang sedih tengok. banyak bangunan baru.

Banyak sgt permintaan utk kirim souvenier + kirim barang2. So, kalau ada sapa2 nak kirim barang tu, silalah.. tapi masukkan duit kat maybank akaun ku.

Ramai yg tanya, nak beli apa... murah ker?? tolong beli dulu lah... huhu.. bukannya murah duit sana tu. i have also no idea what I am going to buy, but for sure, I am gonna send a postcard for each place i visit to my parents.

Maybe Perfume in paris, clothing in milan, cockoo clock in german, watch in swiss.

A good idea on to manage POC (Proof Of Concept) is somehow very different and very depend on the project. Having all Project Members sit down together, compiling report from each activities, and get a feedback is a key factor to the project success.

By inviting people from each different background will make it more interesting to compile a report. This is quite different if you have such progress meeting in technical depth.

The first initiative should be the Project Manager who will line out the agenda as follow:-

1-Objective->Scoping->Exclusion
2-Agenda
3-Project Plan
4-Activity Findings
5-Summary
6-Go or No-Go.
7-Project Close/Next Phase.

10th Feb 2007, it is the first time I have ever climb a 'mountain' at the highest peak of 875M. Counting the day prior climbing the mountain, I have read some articles, blogs who had experienced climbing the mountain which some said it is very dirty and not-challenging.

From my experienced, climbing start at 10:00AM and going down to the base at 7:00PM, it is really exhausted. It is not so dirty as some said. You can see all the natural, green, windy environment.

Untuk mendaki, anda perlu mendaftar dengan Jabatan Hutan ( if I am not mistaken), and you must be accompanied by the rangers. Kami mendaki bersama lebih kurang 30 orang, dan setiap seorang perlu membayar RM20 termasuk kos makan tengahari.

Peralatan yang perlu di bawa, kalau boleh, 1 tong air, sebab memang letih nak panjat. Anda tidak akan rasa berat membawa muatan di sebabkan penat mendaki lebih kepada mental challenging. 1 jam berjalan dari base-camp, kemudian anda akan menemui anak-sungai. ( kalau air dah habis, refill kat sungai nie, air dia memang boleh minom).

Mula2 tu memang lah boring nak naik, tapi bila dah start mendaki, memang takda can lah nak menyanyi lagu Dialova.. nasib baik tak hujan.

Tapi yang frust nya, bila dah sampai atas, dia punya top tu, di kelilingi semak, so tak dapat nak tengok keliling dengan pemandangan ke bawah.
